Acceptance of Terms.

Welcome to MME Giant Designers. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "You") and MME Giant Designers ("Company", "We", "Us", or "Our").

By accessing our website, using our services, or placing an order with us, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Shipping & Returns Policy.

Important: If you do not agree with any part of these Terms, you must not use our website or services. Continued use constitutes acceptance of any updates or modifications to these Terms.

1.1 Entire Agreement

These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and MME Giant Designers regarding your use of our website and services, and supersede any prior agreements or understandings.

1.2 Language

These Terms are provided in English. If translated into other languages, the English version shall prevail in the event of any conflict or inconsistency.

MME Giant Designers is a proudly South African bespoke clothing brand based in Boksburg, Gauteng. We design, tailor, and sell premium clothing for men, women, and children, and offer custom tailoring services.

Eligibility & Age Requirements.

To use our website and services, you must meet the following eligibility requirements:

  • Be at least 18 years of age, or have the consent of a parent or legal guardian
  • Have the legal capacity to enter into binding contracts under South African law
  • Provide accurate, current, and complete information during the registration or ordering process
  • Not be prohibited from using our services under any applicable law

3.1 Minors

If you are under 18, you may only use our website and services with the involvement and consent of a parent or legal guardian. We reserve the right to refuse service to anyone without providing a reason, particularly where we suspect underage use without proper consent.

Parental Consent: For orders involving children's clothing, we assume the purchaser is a parent or legal guardian acting on behalf of the child.

Orders & Purchases.

By placing an order through our website, WhatsApp, email, or in-person at our studio, you are making an offer to purchase products or services from us, subject to these Terms.

4.1 Order Acceptance

All orders are subject to acceptance by MME Giant Designers. We reserve the right to:

  • Refuse or cancel any order for any reason (e.g., product unavailability, pricing errors, suspected fraud)
  • Require additional verification before processing an order
  • Limit order quantities per customer
  • Cancel orders placed using fraudulent or invalid payment methods

4.2 Order Confirmation

Upon placing an order, you will receive an order confirmation via email or WhatsApp. This confirmation does not constitute acceptance of your order — acceptance occurs only when we dispatch your order or begin production (for custom items).

4.3 Product Descriptions

We strive to provide accurate product descriptions, images, measurements, and pricing. However:

  • Colours may appear differently on your screen due to monitor settings
  • Handcrafted items may have slight variations from product images
  • We reserve the right to correct any errors in product descriptions or pricing

4.4 Pricing Errors

If a product is listed at an incorrect price due to a typographical error or system glitch, we reserve the right to refuse or cancel orders placed at the incorrect price, even after order confirmation. You will be notified and given the option to purchase at the correct price or cancel.

Custom Orders: Custom and bespoke orders are non-refundable once production has begun, except in cases of defective workmanship or significant deviation from agreed specifications. See Section 6 for details.

Pricing & Payment.

All prices are listed in South African Rand (ZAR) and include Value Added Tax (VAT) at the prevailing rate, unless otherwise stated.

5.1 Price Changes

We reserve the right to change our prices at any time without prior notice. However, price changes will not affect orders already confirmed and paid for.

5.2 Payment Methods

We accept the following payment methods:

  • Electronic Funds Transfer (EFT) — Direct bank transfer
  • Credit/Debit Cards — Visa, Mastercard (via secure payment gateway)
  • Mobile Payments — Selected mobile payment platforms
  • Cash — In-person at our Boksburg studio
  • Instant EFT — Via PayFast, Yoco, or similar gateways

5.3 Payment Terms

Custom Tailoring 50% deposit upon order, 50% before delivery
Bridal/Couture 50% deposit, 50% at final fitting
Group Orders (5+ items) 30% deposit, balance before delivery

5.4 Late Payments

For orders with outstanding balances, we reserve the right to:

  • Suspend production or delivery until payment is received
  • Charge interest on overdue amounts at the maximum rate permitted by law
  • Cancel the order and retain the deposit as a cancellation fee

5.5 Currency & Taxes

All transactions are conducted in South African Rand (ZAR). International customers are responsible for any currency conversion fees charged by their bank, as well as any import duties, taxes, or customs fees applicable in their country.

Custom & Bespoke Orders.

Custom and bespoke orders are specially crafted to your measurements and specifications. Due to their personalised nature, they are subject to additional terms.

6.1 Consultation & Design

All custom orders begin with a consultation (in-person, via WhatsApp, or video call) where we discuss:

  • Your design vision and requirements
  • Fabric selection and availability
  • Measurements (taken by our team for accuracy)
  • Timeline and pricing
  • Any special requirements or modifications

6.2 Design Approval

Before production begins, we will provide you with a design sketch, fabric swatches, and a written quotation. Production will not commence until you have provided written approval (via email, WhatsApp, or signed quotation).

6.3 Production Timeline

Custom orders typically take 7–21 business days from approval, depending on complexity. Bridal and couture commissions may take 2–6 months. We will provide an estimated completion date at the time of order, but this is an estimate only and not a guaranteed delivery date.

6.4 Fittings

Custom orders include 2–3 fittings (depending on package) to ensure the perfect fit. You are responsible for attending scheduled fittings. Failure to attend fittings may delay your order.

6.5 Cancellation Policy for Custom Orders

Important: Due to the bespoke nature of custom orders, cancellations are subject to the following fees:
  • Before design approval: Full refund of deposit
  • After design approval, before production: 30% cancellation fee
  • After production has begun: No refund (deposit and payments are non-refundable)

6.6 Measurement Responsibility

While we take all measurements professionally, you are responsible for:

  • Informing us of any weight changes or body changes after measurements are taken
  • Attending fittings as scheduled
  • Communicating any fit concerns immediately during fittings

We offer free alterations within 30 days of delivery for custom orders to address minor fit adjustments. Major alterations (requiring significant rework) may incur additional charges.

Shipping & Delivery.

We offer multiple shipping options across South Africa and internationally. Full details are available in our Shipping & Returns Policy.

7.1 Delivery Times

Delivery times are estimates only and begin from the date of dispatch (not order placement). We are not liable for delays caused by:

  • Courier service delays
  • Customs clearance (international orders)
  • Weather, natural disasters, or force majeure events
  • Incorrect or incomplete address provided by customer
  • Public holidays or strikes

7.2 Risk of Loss

Risk of loss or damage to products passes to you upon delivery (i.e., when the courier marks the item as delivered, or when you collect from our studio). We insure all shipments, and will assist you with claims in the event of loss or damage during transit.

7.3 Failed Delivery Attempts

If delivery is attempted and unsuccessful (e.g., no one available to receive the package), the courier will hold the package at a collection point for 5–7 business days. If not collected, the package will be returned to us, and you will be responsible for return shipping costs plus re-delivery fees.

7.4 International Orders

For international orders:

  • You are responsible for all import duties, taxes, and customs fees
  • Delivery times vary by destination (typically 7–14 business days)
  • We are not responsible for delays caused by customs authorities
  • Returns from international customers are at the customer's expense

Returns & Refunds.

We want you to love every MME Giant piece. Our returns policy is designed to be fair and hassle-free, in compliance with the Consumer Protection Act.

8.1 Eligible Returns

You may return ready-to-wear items within 30 days of delivery if:

  • The item is unused, unworn, unwashed, and in original condition
  • All original tags are attached
  • The item is returned in its original packaging
  • You provide proof of purchase (order number or receipt)

8.2 Non-Returnable Items

The following items cannot be returned (except if defective):

  • Custom/bespoke orders — Made to your specifications
  • Sale items — Eligible for exchange or store credit only
  • Earrings, swimwear, underwear — For hygiene reasons
  • Gift cards — Non-refundable
  • Personalised/monogrammed items — Final sale

8.3 Refund Process

Upon receipt and inspection of returned items, refunds will be processed within 5–7 business days to the original payment method. Store credit is issued instantly.

8.4 Exchanges

Exchanges are available for size, colour, or style swaps on ready-to-wear items within 30 days. We cover exchange shipping costs within South Africa.

8.5 Defective Items

If your item arrives damaged or defective, please notify us within 48 hours with photos. We will arrange a free return and provide a replacement or full refund.

Warranties & Quality Guarantee.

We stand behind the quality of our products. All MME Giant Designers items come with the following warranties:

9.1 Quality Warranty

We warrant that all products:

  • Are of merchantable quality and fit for their intended purpose
  • Are free from defects in materials and workmanship
  • Match the descriptions and samples provided
  • Comply with the Consumer Protection Act

9.2 Warranty Period

Our quality warranty covers defects for 6 months from the date of delivery, provided the item has been used and cared for according to the care instructions provided.

9.3 Warranty Exclusions

The warranty does not cover:

  • Normal wear and tear
  • Damage caused by improper care, washing, or storage
  • Alterations or repairs made by third parties
  • Damage caused by accidents, misuse, or negligence
  • Fading or colour changes due to exposure to sunlight or chemicals

9.4 Remedy

If a product is found to be defective within the warranty period, we will, at our discretion:

  • Repair the defect at no cost, OR
  • Replace the product with an identical or similar item, OR
  • Refund the purchase price

Intellectual Property.

All content on our website and all products designed, created, or sold by MME Giant Designers are the intellectual property of MME Giant Designers or its licensors, and are protected by South African and international copyright, trademark, and other intellectual property laws.

10.1 Protected Content

This includes, but is not limited to:

  • Trademarks: MME Giant Designers logo, brand name, and all related marks
  • Designs: All clothing designs, patterns, prints, and original artwork
  • Website Content: Text, images, graphics, videos, layout, and code
  • Photography: All product and lifestyle photography
  • Marketing Materials: Brochures, lookbooks, social media content

10.2 Permitted Use

You may:

  • View and download content for personal, non-commercial use
  • Share product links on social media (with proper attribution)
  • Use our products in personal photography (with credit to MME Giant Designers where reasonable)

10.3 Prohibited Use

You may not, without our prior written consent:

  • Reproduce, distribute, or sell our designs, patterns, or products
  • Create derivative works based on our designs
  • Use our trademarks or branding without permission
  • Scrape, copy, or systematically extract content from our website
  • Use our content for commercial purposes without a licence agreement
Counterfeit Products: We actively monitor and take legal action against counterfeit products. If you encounter fake MME Giant products, please report them to legal@mmegiant.co.za.

User Accounts.

If you create an account on our website, you agree to the following:

11.1 Account Responsibility

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account credentials
  • Promptly notify us of any unauthorised use of your account
  • Accept responsibility for all activities that occur under your account

11.2 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Prolonged inactivity
  • Abuse of our services or staff

11.3 Account Data

Upon termination, we may retain certain account information as required by law (e.g., transaction records for tax purposes). You may request deletion of your personal data in accordance with our Privacy Policy.

Our website is provided for your personal, non-commercial use. By using our website, you agree not to:

  • Transmit any viruses, malware, or harmful code

Limitation of Liability.

To the maximum extent permitted by applicable law (including the Consumer Protection Act), MME Giant Designers shall not be liable for any:

13.1 Excluded Damages

  • Indirect, incidental, special, or consequential damages (e.g., loss of profits, revenue, data, or business opportunities)
  • Losses arising from use or inability to use our website or products
  • Errors or inaccuracies in website content, product descriptions, or pricing
  • Delivery delays caused by couriers, customs, or force majeure events
  • Unauthorised access to your personal data (provided we have implemented reasonable security measures)
  • Third-party actions or services (e.g., courier delays, payment gateway failures)

13.2 Liability Cap

Where we are found liable despite the above limitations, our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

13.3 Exceptions

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Breach of our obligations under the Consumer Protection Act that cannot be excluded by law
  • Any other liability that cannot be excluded or limited under applicable law
Consumer Protection Act: Nothing in these Terms is intended to limit, exclude, or restrict your rights under the Consumer Protection Act 68 of 2008, to the extent that such rights cannot be limited by agreement.

Indemnification.

You agree to indemnify, defend, and hold harmless MME Giant Designers, its owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Terms
  • Your misuse of our website or services
  • Your violation of any third-party rights (including intellectual property rights)
  • Your violation of any applicable law or regulation
  • Any content you submit or transmit through our website

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in defending such claims.

Dispute Resolution.

We are committed to resolving disputes fairly and efficiently. If you have a complaint or dispute with us, please follow this process:

15.1 Step 1: Contact Us Directly

We aim to respond to all complaints within 5 business days and resolve them within 15 business days.

15.2 Step 2: Formal Complaint

If your issue is not resolved through direct contact, you may submit a formal written complaint to our Information Officer at legal@mmegiant.co.za. Your complaint should include:

  • Your full name and contact details
  • Order number or reference (if applicable)
  • A clear description of the issue
  • The outcome you are seeking
  • Any supporting documentation (photos, receipts, correspondence)

15.3 Step 3: Alternative Dispute Resolution

If we cannot resolve your complaint internally, you may refer the matter to:

  • Mediation or Arbitration — As agreed by both parties

15.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes with us on an individual basis and not as part of a class, consolidated, or representative action.

Governing Law & Jurisdiction.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

16.1 Jurisdiction

Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa, specifically the courts within the Gauteng Province.

16.2 International Users

If you are accessing our website or services from outside South Africa, you are responsible for compliance with your local laws. We make no representation that our website or products are appropriate or available for use in other jurisdictions.

16.3 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by both parties.

We reserve the right to modify these Terms at any time, at our sole discretion. Changes may be made to:
